PLACING AN ORDER

By placing an order with Andaluchic (also referred to as “us”, “we” and “our”) the customer (also referred to as “you” and “your” and “visitor”) will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with or unclear about any aspect of these terms, please contact us via our contact form or by writing to the address given in Our Details.

By placing an order via this website you are making an offer to Andaluchic to purchase the goods detailed in your order upon the terms described in your order.

An order can be placed on the Andaluchic website in English, Spanish,  French, italian or German.
On your placing an order we will send you a confirmation that your order has been received.  Once an order has been accepted, processed and dispatched to you a contract between you and Andaluchic for the sale of our products will exist and will be confirmed to you by email.  Prices are in Euros (€) and availability of goods are subject to change without notice.
A delivery charge will be added to your order value. All orders are dispatched from our premises in Spain.  Please see our Orders, Returns & Damaged Items for more details. Your credit/debit card/PayPal account will be authorised when your order is placed and processed.
This does not affect your statutory rights.

All dates quoted for delivery are estimated delivery dates only and may be subject to change. We can accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.

GIFT VOUCHERS

Gift Vouchers can be used online at 

www.andaluchic.com

Gift Vouchers cannot be exchanged or refunded for cash.  Gift Vouchers can be used towards the purchase of goods at a higher price than its face value upon payment of the difference.  Vouchers can be redeemed subject to the deadline expressly specified on the voucher. Andaluchic does not accept liability for the replacement or refund of vouchers should vouchers be lost, stolen, damaged or destroyed whether they have been redeemed or not. Furthermore, we reserve the right to refuse any vouchers that have been modified, damaged or defaced. Gift Vouchers are only valid with a unique serial number on the reverse.

LEGAL GUARANTEE

The products offered at Andaluchic are handmade and are new and must conform with the contractual specifications given. Our products are covered by a 2 year guarantee, established by the European Directive 1999/44/CE, starting from the purchase date of the new product and in accordance with the provisions of the consumer and user regulations. The legal guarantee only applies to consumers who purchase products for non-professional use. If you wish to make a claim under this guarantee, please contact us either by our contact page on our website or on the details given under Our Details.

CONFORMITY OF GOODS

Our products are handmade and so are subject to slight variations in measurements, design and colour from those shown on our website.  We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.

STOCK AVAILABILITY

We endeavour to display through this website all items in our current range. We aim to hold stock of all styles and sizes whilst a product is active. However, occasionally an item will be out of stock and if this is the case this will be highlighted at the point of selecting an item.  Occasionally a product may show as being in stock when it is not, due to software updates which do not always take place in real time.  

ORDERS

On placing an order, certain personal details are required to facilitate your order.  In accordance with EU regulations, such information will not be divulged to any third parties (please see our Terms & Conditions for more details about our Privacy Policy).

Why will we ask you for a phone number? 

This is to help the carrier should they need to contact you in advance of delivery.

Why will we ask you for an ID number? 

For any buyer purchasing in Spain, Italy & Chile this is a requirement.  For private buyers purchasing outside Spain ID is not required.  For company purchases a TAX number is required.

RETURNS

If you are not 100% satisfied with your purchase, simply send it back within 14 days and we’ll refund the full cost of the item plus the initial postage paid.

Items must be in new condition, unworn, unused, unaltered and free of damages by the customer.
Items must be returned with all Andaluchic tags still attached (where applicable) and must be in their original packaging.  Return postage is the responsibility of the buyer.  We recommend using either registered post or a service with a tracking number as items not received cannot be refunded.

DAMAGED ITEMS

At Andaluchic we send out all products fully insured in case of damage or loss.
In the unlikely event that an item arrives damaged, please send the following via email to hello@andaluchic.com, within 7 days of receipt.

1. A photo of the packaging and original courier label in which the item(s) arrived together with the damaged item(s) inside the packaging

2. A photo of the damaged item

3. A photo of the packaging in which the damaged item(s) arrived, which must include the original courier label

4. A detailed description of damage to the item

Such evidence is required by our insurance company and without it, claims for damaged items cannot be processed.

PRICES

All prices quoted on this website are accurate at the time of publication and are quoted in Euros (€) with Spanish taxes included. Shipping costs are not included.  If you are located outside the EU, you will be responsible for the payment of any customs or import duties levied once the package reaches your destination country.

DATA PROTECTION

As required under EU Legislation 34/2002 for Society of Services for Information and Electronic Commerce, Andaluchic will never share, divulge or sell customer´s, or recipients of our goods, personal details (including but not limited to names, addresses, age, sex, emails, telephone numbers or ID numbers), or the personal details of individuals who sign up to our newsletter or follow any of our social media, with third parties.  We will only contact you because you are a customer of Andaluchic, in response to an enquiry to Andaluchic or because you have agreed to receive our Newsletter, follow our Social Media (also referred to individually as “Facebook”, “Twitter”, “Instagram”, “Pinterest”,  “Linkedin”, “Google+” and “Blog”) or receive special offers and promotions or giftvouchers from Andaluchic.  The customer can unsubscribe to our Newsletter, Blog, Social Media or Offers and Promotions at any time.  The customer declares that any personal data facilitated to Andaluchic is true and correct and will inform Andaluchic if such data changes.  In cases where the Customer facilitates personal information on behalf of a third party, the Customer is responsible for obtaining consent from the third party.  Andaluchic is not responsible for ensuring that such consent was obtained.

VISITOR PROVIDED MATERIAL

Any material that a visitor to "https://www.andaluchic.com", sends or posts to this Website shall be considered non-proprietary and non-confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under Spanish Law 15/1999 of the 13^thDecember of the Protection of Personal Data (known under Spanish Law as “La Ley Orgánica 15/1999 de 13 de diciembre de Protección de Datos de Carácter Personal (LOPD)”) and EU Legislation 34/2002 for Society of Services for Information and Electronic Commerce.

When using this website you shall not post or send to or from this Website any material:

1. for which you have not obtained all necessary consents;

2. that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in Spain & European Union; 

3. which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data; 

4. Andaluchic is not responsible for comments made by users of the website;

We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph“visitor provided material”.

DISCALIMER AND LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, neither Andaluchic nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Andaluchic or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you. 

The limitations of liability in these conditions shall apply equally for the benefit of Andaluchic (Spain) and any included references to any associated company.

While Andaluchic uses reasonable endeavours to ensure that the information on this website is accurate and up to date, for example, but not limited to prices, description and colours, it does not give any warranty as to its accuracy or completeness and Andaluchic will not be responsible for any errors or omissions or for the results arising from the use of such information. While Andaluchic takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Further, Andaluchic will not be responsible or liable for your use of any other websites which you may access via links within this website. Andaluchic does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Andaluchic. The entire liability of Andaluchic under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

Andaluchic will not be liable to you or be deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

Andaluchic is the owner of all the intellectual and industrial property rights of the Website, as well as the elements contained therein (including but not limited to images, sound, audio, video, software or texts, trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.). They are, therefore, works protected as intellectual property by the Spanish legal system, being applicable to both Spanish and EU regulations in this field, as well as international treaties on the subject agreed to and signed by Spain. ALL RIGHTS RESERVED. The copying, modification, distribution, reproduction, or incorporation into any other work of part or all of the material available on this website in any form is prohibited save that you may:

Copy, print (one copy only) or download extracts of the material on this website for the sole purpose of using this website in good faith for domestic purposes or placing an order with Andaluchic; and

Copy, print (one copy only) or download the material on this website for the purpose of sending to individual third parties for their personal information provided that you do seek no commercial advantage or benefit from so doing and you acknowledge us as the source of the material and that you inform the third party that these conditions apply to them and that they must comply with them.

These Terms and Conditions and your use of our website are governed by Spanish law and you agree to submit to the non-exclusive jurisdiction of the Spanish court.  This does not affect your non-excludable statutory rights.  This website and our Terms and Conditions have been designed for use within Spain and under Spanish law.  Whilst we are happy to consider requests for products and enquiries from outside Spain, we give no warranty, express or implied that the use of this website or the placing of any order through this website from outside the Spain complies with any applicable non-Spanish or applicable EU laws or regulations.  Accordingly, any products or promotions not permitted under your local law are not offered to you.
